1. Acceptance of Terms
By accessing or using the Benetelligence platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Subscription Plans
Benetelligence offers three subscription tiers: Free, Professional, and Enterprise. Each tier provides different levels of access to our data and features as described on our Pricing page. Subscription fees are billed in advance on a monthly or annual basis.
3. Acceptable Use
You agree to use the platform only for lawful purposes and in accordance with these Terms. You may not use the platform to violate any applicable laws, infringe intellectual property rights, transmit harmful content, or attempt to gain unauthorized access to our systems.
4. Employer Identification Number (EIN) — Voluntary Disclosure and Authorized Use
Company-type users (HR professionals, Insurance Companies, and Other Vendors) may be invited to provide their organization's Employer Identification Number (EIN) during the account setup process. Providing your EIN is used exclusively for: (a) verifying your company identity on the Benetelligence platform; (b) matching your organization to publicly available government benefits data, including Form 5500 filings published by the U.S. Department of Labor; and (c) generating your unique Benetelligence Account Number (BEN-XXXXXX), which replaces your EIN in all platform communications, invoices, and reports. By providing your EIN, you represent that you are authorized to disclose this information on behalf of your organization. Benetelligence will not use your EIN for any purpose other than those stated above, will not display it in the platform interface or any external document, and will not share it with any third party. Your EIN is stored using AES-256-GCM encryption at rest.
5. Data Usage
The data provided through the Benetelligence platform is for informational purposes only. While we strive for accuracy, we make no warranties about the completeness or accuracy of the data. Users should independently verify data before making business decisions.
6. Intellectual Property
The Benetelligence platform, including all data enrichment methodologies, algorithms, and proprietary datasets, is the intellectual property of Benetelligence, Inc. You may not reproduce, distribute, or create derivative works without our express written consent.
7. Limitation of Liability
Benetelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service, even if we have been advised of the possibility of such damages.
8. Governing Law
These Terms shall be governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
